Customs agent, definition: A customs agent is a foreign trade professional, as a specialist in foreign trade, he facilitates all administrative tasks related to the import and export of products. A customs agent, also called a customs broker or customs representative, fulfills the function of facilitating and presenting the necessary procedures for importing and importing merchandise. A customs broker must know all the national and international regulations involved in foreign trade, a customs agent has the power to legally represent a company therefore the customs agent is the legal representative of the importer or exporter before the authorities governmental.

A customs agent can fulfill his functions as a foreign trade manager both in private companies and in government agencies. As a foreign trade professional, you must have an exhaustive knowledge of the legal, accounting, and tax regulations involved in foreign trade, as well as the cost-benefit ratio of imported and exported products to generate the best profitability in a company.

To fulfill his functions, a customs agent must be authorized by the General Directorate of Customs and Excise Taxes. Such authorization allows the customs professional to present all the necessary documentation before the regulatory entity.

During the process of importing and exporting merchandise or products, there are different added costs which a customs agent must know in order to be able to estimate the costs that occur both in the purchase and sale of products internationally.

Any person who wishes to fulfill the role of customs agent must pass the necessary requirements demanded by both Spain and the legal requirements demanded by the European Union. 

  • Approve all tax and customs regulations in foreign trade
  • Know and pass the Excise Tax exams
  • Must comply with all smuggling regulation requirements
  • Know as much as possible all the regulations on contracts for the sale of merchandise and international transport regulations
  • A customs agent in Spain must know and demonstrate the legal norms of foreign trade referring to the Economic and Fiscal Regime of the Canary Islands as well as the special regimes of Ceuta and Melilla (Spanish enclaves in North Africa).
