Is the bill of lading mandatory?

The bill of lading is the effective transport document that can act as a control document and is issued because it exists and attests that there is a transport contract, these are related, but they are two different things. 


With the entry into force of Royal Decree Law 14/2022, the distinction between the types of land transport is issued, and in which cases it is necessary to issue a bill of lading.
Bills of lading are mandatory when the price of transport is greater than €150. In these cases, it is necessary to issue the control document that must contain a series of mandatory data for it to be valid, these data are:

  • Name, NIF and corporate name of the shipper or shipper. 
  • Name, NIF and corporate name of the effective carrier. 
  • Day, time and place of receipt of the merchandise by the carrier. 
  • Day, date and expected time of delivery of the merchandise. 
  • ​ 
  • Merchandise: weight, dimensions, volume, etc. must be detailed. 
  • Price of transport: the price of transport must be reflected, as well as the expenses related to transport, unless this price is stated in another written contractual document.

 There is no official bill of lading model, so any type of document will be valid, whether in paper or digital format, as long as it contains all the corresponding sections.
In case of being issued on paper, the LCTTM indicates that it must be issued in triplicate, while, if it is digital, it will be valid as long as it can be transformed into paper format.
